Editorial: Joe incites another Constitutional crisis

Column By Mike Bibb

“No state shall, without the consent of Congress. . .engage in war, unless invaded, or in such imminent danger as will not admit of delay.”

Article I, Sec. 10, United States Constitution

President Joe seems to have a natural propensity to incite national issues which he, and his staff, appear clueless how to successfully resolve.  Other than throwing piles of money at it expecting things will get better.

As a result, matters continue to spiral out of control.

It’s pretty much an accepted fact our country is being overrun with foreign migrants from all over the world.  Approximately nine to ten million have traipsed across the southern border within the last three years – more people than the combined populations of Arizona and New Mexico.  There isn’t a city, or state, that is not experiencing some aspect of this invasion.

This includes death and destruction inflicted by human trafficking and untold amounts of illicit narcotics.

In a single month, December 2023, an estimated 302,000 illegally crossed.

Texas is bearing the brunt of the assault, as millions have poured in, seeking refuge and depleting social services.  The costs are enormous to Texas’ residents.

In response, Texas has been compelled to erect defensive barriers to slow the intrusions, since Border Patrol enforcement efforts have been substantially reassigned to administrative duties by a non-caring Biden Administration.

Which, incidentally, continues to spew the big lie that “The border is closed,” even while news cameras film the onslaught.

In an act of desperation, Texas Department of Public Safety, and other agencies, have placed various protective measures along its border with Mexico.  Including, but not limited to coiled steel razor wire fencing.  The state National Guard has also been deployed at various times.

Tensions have been steadily building between Austin and Washington.  Texas is determined to defend itself from the encroaching waves of humanity, while the big brains in D.C. appear equally resolute to undermine Texas’ efforts.

Unbelievably, Texas Rep. Joaquin Castro (D), has urged President Biden to seize control of the Texas National Guard if Gov. Greg Abbott continues to ignore a Supreme Court ruling that permits Customs and Border Patrol to cut and remove the razor wire.

Posting on his website, Rep. Castro suggested “Governor Abbott is using the Texas National Guard to obstruct and create chaos at the border.  If Abbott is defying yesterday’s Supreme Court ruling (Jan. 22), @POTUS (President Biden) needs to establish sole federal control of the Texas National Guard now.”

Governor Greg Abbott is using the Texas National Guard to obstruct and create chaos at the border. If Abbott is defying yesterday’s Supreme Court ruling, @POTUS needs to establish sole federal control of the Texas National Guard now.

Wow, I thought Democrats are ranting over Trump becoming a potential dictator.  Sounds like Rep. Castro believes Biden should act like one by encouraging him to take over the Texas National Guard.

Technically, Joe could probably do it, but public blowback would be significant.  Maybe, too overwhelming for a politician to recover from.  Begging the question, why would Joe even try, knowing the uproar it would cause?

Gov. Abbott responded-

Greg Abbott

The Texas National Guard continues to hold the line in Eagle Pass. Texas will not back down from our efforts to secure the border in Biden’s absence.

CBP and the National Guard are agencies who are supposed to enforce border protection, not make it easier for illegals to enter.  Apparently, Rep. Castro does not seem concerned about the safety of his own constituency.  Rather, more sympathetic towards those unlawfully entering the country.

Almost from the beginning of his presidency, Biden has managed to nearly disassemble our southwestern border.  He appointed Vice President Kamala Harris to be some kind of make-believe “Czar,” in charge of getting to “the root causes of the border problem.”

Of course, Joe’s assignment of Kamala to watch over our southern flank is like expecting Charlie Brown to finally successfully kick a field goal.  Everyone, including Lucy, knows that’s not going to happen.

Similar to Democrats insisting Donald J. Trump should be removed from the voting ballots in various states, citing the 14th Amendment as the basis for their argument, now they are saying Article I, Sec. 10, of the Constitution provides authority for the federal government to suspend Texas’ right to defend itself by commandeering its National Guard.

What’s next, a federal declaration that the citizens of Texas no longer have 2nd Amendment rights?

Democrats failed to comprehend the entirety of the 14th Amendment – posting only a portion of the amendment they believe grants them permission to boot Trump off the ballot — they are equally derelict in reading and understanding the complete contents of Art. 1, Sec. 10.

Especially, the part that grants states the absolute right to repel invaders without waiting for Congress to act (see above).

Readers may note the authors of Art. I, Sec. 10, did not specifically say an “armed” invasion was necessary for a state to react and protect itself — “imminent danger” was sufficient.

Which is exactly what Texas is doing – since Joe Biden and Congress have been dragging their feet for three years while millions of foreign nationals overrun the Lone Star State.

Just because the hoards are not packing firearms and dressed like soldiers, does not necessarily mean they do not pose a danger or don’t have access to weapons once inside the country.

Twenty-five states have already sided with Texas, many pledging to dispatch members of their own National Guard units to assist Texas in its struggles.

Before a U.S. v Texas clash further escalates – a very real possibly under Joe’s disoriented leadership – it might be wise to consider the advice of the popular local witticism – “Don’t Mess With Texas.”

Perhaps, the bottom line of the border controversy is why the Biden Administration remains intent on aiding and abetting a strategy that is clearly a threat to the peace and safety of our country?

There has to be a reason.  What is it, and how come Joe is pushing it so hard?  Or, does he even realize what is going on, instead assigning that responsibility to a select committee of like-minded acolytes?
