Man arrested for DUI after found in the drive-through of closed restaurant

A man was arrested for DUI after being found waiting in the drive-through of the Los Jilbertos restaurant after it had closed for the night.

SAFFORD – A man was arrested for DUI after an officer noticed a vehicle waiting in the drive-through of the Los Jilbertos restaurant after closing. 

According to a Safford Police report, an officer was westbound on U.S. Highway 70 at about 1:05 a.m. when he noticed a truck stopped in the drive-through of the restaurant at 215 E. U.S. Highway 70. 

Upon contact, the officer questioned what the driver was doing. The driver, identified as Mark Macario Lopez, allegedly advised he was trying to get some food. 

The officer then informed Lopez that the restaurant was closed for the night. At that time, the officer also noted that Lopez appeared intoxicated. 

Lopez allegedly admitted drinking at a friend’s house and a local bar before driving to attempt to get food. 

After failing a field sobriety test, Lopez declined taking a portable breath test and was arrested for DUI. A friend was then called to retrieve his truck. 

Lopez was taken to the Safford Police Department, where his blood was taken for testing purposes. He was then released to a friend with possible DUI charges pending lab analysis results of his blood and review by prosecutors.
