In the Superior Court of the State of Arizona, re the marriage of Timothy Cason vs. Elysha Berry, in and for the county of Gila, comes now Petitioner/Husband, Timothy Cason, by and through undersigned Paraprofessional, and hereby files this brief memorandum as her Application for Entry of Default and Attorney’s Affidavit.

I hereby give notice that I am requesting entry of default against the Respondent/Wife, Elysha Berry, because she has not filed an Answer/Response to Husband’s Petition for Dissolution of Non-Covenant Marriage Without Minor Children filed May 6, 2025.
Service was completed July 28, 2025, via Publication. The Notice of Filing Affidavit of Publication is attached hereto as Exhibit “A.” Respondent has not answered, responded, or otherwise defended in the time required by law. Respondent is not represented by counsel. Respondent is either not in the active military service of the United States or has otherwise waived her rights under the Service Members’ Civil Relief Act (formerly “Soldiers and Sailors’ Civil Relief Act”).
By completing the Certificate of Mailing, undersigned counsel certifies to the Court that this Application and Affidavit for Entry of Default will be published upon receiving a court-stamped copy.
I understand that Petitioner/Husband will not qualify for default if the document is not mailed, and or the Certificate of Mailing is not completed.
